Who I am:
I’m an independent game developer. I have spent over a year and a half programming and designing a turn based card game that will be sold on Xbox live as a downloadable title.

My game, Empire Tactics requires 300+ images to be used as cards, which is why I’m contacting you. I would be interested in potentially licensing one or more of your images for my game. Please keep in mind this is only to be potentially used, the design team may choose to cut a few cards in the coming months. There is still 6 months of development to undergo.

My proposal:
I propose we band together your art work with my game engine to create a game product that will be sold on Xbox Live Community Games ([link]). The profit from the game will be shared between us. The ownership of your art remains yours and the ownership of my game remains mine.

I am planning to offer 10% to 15% of the profit, after expense, to the card image contributors.
The 10% to 15% of the profit figure considers:

1 - The total hours it has taken to produce the project thus far.
2 - Estimations of the hours to come in content design, level design, programming, producing, graphics, web design, translations, ect.
3 - The estimated time it would take to produce the crowdsourced assets, art, music, and sound effects.
4 – The assets which can be crowdsourced are more abundant and are being licensed not owned. (The designer/playtester who works on this project doesn’t have something they can license again, is working specifically on this project, and is not maintaining ownership of the specific cards/levels they make)

Simplified to $50 000 of profit and an estimated 300 images that’s.
15% * $50 000 / 300 = $25
to
10% * $50 000 / 300 = $16.66
That averages out to $20.83 on every $50 000 the product makes, $10.41 evenly distributed and $10.41 to the professional quality pieces.

Keep in mind I am not obtaining ownership of your image, I am nonexclusively licensing it. This means that you can sell its print, that I would need to license it from you again for another release of Empire Tactics, and that you could license it to another production.

I plan to distribute a beta copy of Empire Tactics from [link] where my .ccg game prototype (a file type used for xbox development) and prototype tutorial video are being hosted.

I plan to use a 270x270 pixel crop/reduced copy of your image for the majority of gameplay. The player will be able to view your full image by clicking on the smaller one. I will make a video shortly to show you exactly what it will look like.

In order to proceed with making a beta copy I will need you to email me at windjestergames@gmail.com the following:
1 – The image I am interested in licensing.
2 – Your statement that the image is legally yours to license and that you’re interested in potentially having your piece used in Empire Tactics first release.

I plan to develop a global game development community of artist to continue to produce Empire Tactics sequel set releases. If you’re looking for future free lance work, that would be good to know. Presently, I am looking for one or two graphic artists to produce spell visual effect images and some icons, let me know if you’re interested in that line of work as well.

You should know that I also plan to enter Empire Tactics in Microsoft’s Dream Build Play independent game development competition [link] , any prize money winnings will be treated as profit.

Obviously this is not legally binding. I simply want to open communication, get some feedback, give you a chance to ask any questions you might have, and get your permission to feature your image in my beta copy for the next 4-6 months of development before licensing it for market.

Presently, the game industry is a place ruled by the venture capitalist (people who have enough money to hire an entire company) and the deal maker type producers (people who organize various sources of funding and company management). The open source development studio for the Xbox 360 (called XNA) and the creation of Xbox Live Community Games as a distribution method has given a more feasible rise to the possibility of independent developers creating and growing their own games on a global market (presently 19 million strong). The only obstacle in bringing a game to market is making the game, the two major challenges faced in that are finding enough hours to work on it and collecting enough people interested in doing so. In doing this we form not a company owned by a venture firm but a group of creators brought together by our desire to create. We collectively create something we collectively own and we maintain ownership of what it is we individually make. This dream is now a business plan.
